Dilu seeking to review court’s decision

Following the National Court’s decision to declare the election of Kundiawa-Gembogl MP, Muguwa Dilu, null and void, and ordering a recount, Dilu’s lawyer has applied for a review of the decision. Lawyer Goiye Gileng submitted an application seeking either dispensation or an exception to review the decision. Another application pending before the Court is to review the decision ordering a recount on June 6, 2024. Additionally, there is an application to review the Supreme Court’s decision on the objection to competency, which was dismissed on June 10, 2024.

Supreme Court Judge Justice Collin Makail, after hearing arguments from the counsels, adjourned the matter to today (Thursday, June 20) for the hearing of the applications. Petitioner William Onglo’s lawyer, Emmanuel Isaac, welcomed the application and provided further explanation.

“Dispensation application is made when time has run out due to urgent circumstances. Dilu applied to the Supreme Court to review the decision of June 6, 2024. That application for leave was pending, but given the period, they filed another application seeking dispensation, which means shortening the period to bring the leave forward due to time constraints.

“We argue that the application for leave to review is incompetent, and the other application for leave to review the objection to competency is an abuse of the court process,” he said.
